Canada's Work Permit Types

In Canada, there are two categories of work permit programs:.

  1. Temporary Foreign Worker Program: A foreign national must complete a Labour Market Impact Assessment before applying for a work visa (LMIA).
  2. Global Mobility Program: A foreign national may apply for a work visa without submitting an LMIA.

Employers are required by the LMIA to prove to the Canadian government that hiring a foreign worker won't have a detrimental effect on the country's current labor force. Employment and Social Development Canada (ESDC), a government agency, seeks to ensure that using foreign labor won't result in lower pay for local employees . .

cause them to be displaced The Temporary category includes employees that need an LMIA.

Even though LMIA applications are the norm, many work permits are LMIA-exempt as a result of free trade agreements, such as the previous North American Free Trade Agreement, currently known as the Canada-United States-Mexico Agreement, or CUSMA. Through these FTAs, foreign workers can apply for work permits without their employer first acquiring an LMIA.

Foreign workers who do not yet have a job offer have access to a variety of different work permit options, such as working vacations, post-graduate work permits, and open spousal work permits, in addition to these employer-sponsored work permits.

An LMIA is not required for employees covered by the International Mobility Program (IMP).

There are a variety of circumstances in which one may work in Canada, some of which are described below:

Query and Response

How may a Labour Market Impact Assessment (LMIA) be obtained?

Before hiring a foreign worker in Canada, Canadian employers must first receive approval from Employment and Social Development Canada (ESDC), often known as a Labour Market Impact Assessment. Employers in Canada must show that there are currently no Canadian citizens or permanent residents who can fill the post and that hiring a foreign worker won't, generally speaking, have a negative effect on the local labor market.

To show that there were no qualified Canadian contenders for the position, the vacancy is typically listed on a number of websites. Due to an LMIA's length and complexity, the government will carefully review it; as a result, it must be correctly filled out.

How can I get a work permit in Canada?

Work permits are handled by two federal departments in Canada. Employment and Social Development Canada will analyze the LMIA application and decide whether to accept it if a labour market effect assessment is necessary.

The department of Immigration, Refugees, and Citizenship Canada is in charge of the procedure for submitting an application for a work permit (IRCC). You submit a work permit application to IRCC following the approval of an LMIA. You can also apply to IRCC for a work permit if an LMIA is not necessary. The task provides you permission to work on a temporary basis in Canada.

The following documents must be submitted to IRCC as part of your application, for instance, if you are requesting a work visa through a stream that calls for an LMIA: one for an employment contract or job offer and an LMIA number.

In general, all candidates must show they'll leave Canada when their work visa expires, that they have enough money to support themselves financially in Canada, and that they don't constitute a security risk.

That they won't work for unqualified companies or take part in illegal behavior, and that they won't pose a threat to the public's health and safety.

Any employer in Canada will hire a foreign worker with an open work permit. A Labour Market Impact Assessment or a job offer are not necessary for foreign nationals to provide when applying to Immigration, Refugees and Citizenship Canada for an open work visa.
